Terms of Service

Placing an order online is an offer to buy. Your order is accepted once we confirm it and it reaches our kitchen. We may decline or cancel an order if an item is unavailable, if the order cannot be prepared safely, or if we suspect fraud or abuse. If we cancel a paid order, we refund it.

Pickup and curbside times are estimates and can shift when we are busy. Please check your order before leaving.

Menu prices come from our register, so what you see here matches what we charge in store. Sales tax and any listed service or card-processing fee are shown in your bag before you pay. Prices and availability can change without notice.

Card payments are processed by our payment provider on their secure page. You confirm you are authorized to use the payment method you provide.

Food is made to order, so we cannot cancel an order once the kitchen has started it. If something is wrong with your order, contact us the same day and we will make it right with a remake or a refund. Event and vendor booth deposits follow the policy shown at booking. • Rewards points are earned on qualifying purchases and have no cash value.
• Promo codes cannot be combined with rewards redemptions or other codes.
• We may expire, adjust or cancel points, codes or referral credit that were earned in error or through abuse.
• We may change or end the rewards program at any time.

Keep your sign-in details private; you are responsible for activity under your account. Tell us right away if you think someone else has access.

Bookings are confirmed only when we accept them and any required deposit is paid. Booking lead times, hour ranges and capacity limits are shown on the booking page. You are responsible for your guests and for leaving the space in the condition you found it.

Our items are prepared in a shared kitchen and may come into contact with nuts, dairy, gluten, soy, eggs or other allergens. We cannot guarantee an allergen-free item. Tell us about allergies before ordering and use your own judgment.

DoorDash, Uber Eats and Grubhub orders are handled by those companies. Their pricing, delivery times, refunds and support are governed by their own terms.

Do not attempt to disrupt the site, access other customers' information, scrape it at scale, or use it for anything unlawful.

The name, logo, taglines, photos and site content belong to Big Apple Delights and may not be reused without permission.

The site is provided as is, without warranties of any kind. To the extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order.

These terms are governed by the laws of the State of Texas, and any dispute will be heard in the courts serving Webb County, Texas.
